An Evboriaria Magistrates’ Court, in Benin, Edo State, has remanded a 21-year-old man, Lucky Igbineyi, in prison custody, for allegedly stabbing his in-law to death over a stick of cigarette.
The Chief Magistrate of the Court, Mrs. Caroline Oghuma, who gave the order refused to entertain any argument on the court’s jurisdiction to hear the matter.
The Police Prosecutor, Inspector Oluwaseun Olatoye had told the court that the accused person committed the crime on September 3, at 40, Enoruwa Street, Off Upper Sakponba Road, Benin City.
He said the accused person unlawfully killed Blessing Obazee by using a knife to stab him in the stomach severally.
The Prosecutor further told the court that the accused person came to stay in the same room with his in-law, (the deceased) in his house.
He explained that on the fateful day, the deceased (Obazee) refused to give the accused person the cigarette he was smoking, forcing the accused person to buy his own cigarette.
According to Inspector Olatoye, the deceased resisted the accused person smoking in his room by dragging the cigarette from the accused person and putting it off in his eye.
This was said to have infuriated the accused person who immediately took a knife and stabbed the deceased to death.
Chief Magistrate Oghuma while ordering that the accused person be remanded at Oko Medium security prison in Benin, pending the advice of the DPP, adjourned the case to Nov 18, 2016 for mention.
She directed that the case file be duplicated and forwarded to the Department of Public Prosecution (DPP) for legal advice.
