Justice Jude Okeke of an FCT High Court will today rule on the no-case submissions filed by embattled judge of the Federal High Court, Justice Adeniyi Ademola, his wife Olabowale and Joe Agi (SAN).
The three were arraigned on an 18-counts charge bordering on gratification and illegal possession of firearms. The prosecution called 19 witnesses to prove its case against the defendants.
However, at the last sitting, counsels to the defendants, Dr Onyechi Ikpeazu (SAN), Chief Robert Clarke (SAN) and Barrister Jeph Njikonye argued that the prosecution has not been able to link the evidence given with the charge filed against the defendants thereby urging the court to uphold the no-case submission.
In his response, prosecution counsel Barrister Segun Jegede said the Supreme Court has held that the prima facie case must be differentiated from prove of guilt and all that is needed at this stage of the trial was for a link to be established between the evidence led and the charge filed against the defendants.
